Terms of Service
Last Updated: October 7, 2026
These Terms of Service ("Terms") are an agreement between you and Michael Kelly, who operates the Flax service ("Flax," "we," "us," or "our"), for access to flaxsites.com and the Flax website builder, hosting platform, editor, agent tools, and related services (the "Service"). By creating an account, purchasing a plan, or using the Service, you agree to these Terms, our Privacy Policy and our Acceptable Use Policy. If you use the Service for an organization, you confirm that you are authorized to accept these Terms for it.
1. The Service
Flax helps businesses and their authorized agencies create, publish, host, and manage websites. Depending on your plan and enabled features, the Service may include a visual site builder and CMS, templates, hosting and CDN delivery, custom-domain tools, translations, contact forms, products, checkout, bookings, events, courses, memberships, reports, analytics integrations, and AI or agent assistance. Features, limits, and prices are shown in the Service or at checkout and may vary by plan, location, and currency.
We may add, change, suspend, or discontinue a feature. If a change materially reduces a paid feature, we will give notice where reasonably practicable and required by law.
2. Accounts and Access
- You must be at least 18 years old or the age of legal majority where you live, whichever is higher, to create an account.
- You must provide accurate account information, keep it up to date, protect your sign-in credentials, and promptly tell us about suspected unauthorized access.
- You are responsible for activity under your account and for deciding who receives access to your sites, agency workspace, and connected services.
- If you invite a collaborator or grant an agent access, you authorize that access at the level you select. You remain responsible for reviewing and changing permissions when they are no longer needed.
- If you manage websites for clients, you must have authority to act for them and must explain to them how you use Flax and any connected services.
3. Plans, Billing, and Refunds
3.1 Plans and charges
Paid plans, billing periods, included features, and prices are displayed in Flax or at checkout. Prices may be shown in different currencies or include taxes based on your location. Unless the checkout page says otherwise, a subscription renews for the same billing period until you cancel it. You authorize the payment provider to charge the payment method you select for recurring charges, applicable taxes, and amounts you approve.
Dodo Payments processes Flax subscriptions and checkout as our merchant-of-record and payment provider. Its buyer terms are available at Dodo Payments' Buyer Terms. Stripe may process connected payments, domain checkout, or other payment features you enable. Those transactions may also be subject to the payment provider's terms.
3.2 Price changes
We may change plan prices or features. We will give existing subscribers at least 30 days' notice of a price increase where required or appropriate. A change will apply from a future renewal after the notice period; you can cancel before then if you do not accept it.
3.3 Cancellation and refunds
You may cancel a subscription through your account settings where available or by contacting contact@flaxsites.com. Cancellation normally takes effect at the end of the current paid billing period; you remain responsible for charges already due. After a paid period expires, publishing or paid features may be paused and a hosted site may be taken offline until the subscription is renewed.
For a first-time purchase, Flax currently offers a 7-day refund window from the initial purchase date. Contact contact@flaxsites.com within that period to request a refund. The refund window does not limit any cancellation or refund rights that cannot be excluded under the law that applies to you. Provider processing times may affect when an approved refund appears in your account.
We do not promise a fixed period for keeping site content after cancellation or account closure. Retention and deletion depend on the data type and are described in our Privacy Policy. Export any content you need before your account or site is closed.
4. Your Content and Website Responsibilities
4.1 Ownership and service license
You keep the rights you hold in text, images, documents, data, and other content that you provide or create ("Your Content"). You grant Flax a worldwide, non-exclusive license to host, store, reproduce, adapt for technical compatibility, translate when you request it, publish, cache, and deliver Your Content only as needed to provide, secure, support, and operate the Service features you use. This license ends when the relevant content is deleted from active Service systems, subject to backup copies, CDN caches, legal or security records, and any license needed to complete transactions already in progress.
Flax and its licensors retain all rights in the Service, including its software, templates, design systems, documentation, and branding. We give you a limited, non-exclusive, non-transferable license to use those parts of the Service made available to your account for the duration of your access, subject to these Terms.
4.2 Your responsibilities as a site owner
You are responsible for Your Content and for each website you create, including the products, services, statements, prices, policies, and claims shown on it. You must have the rights and permissions needed to upload, use, and publish Your Content; keep account and site access secure; and comply with the laws that apply to your business and visitors worldwide.
If your website collects information, sells goods or services, takes bookings or payments, uses cookies or analytics, or serves children or regulated audiences, you are responsible for providing the required disclosures, obtaining consent where required, honoring consumer and privacy rights, configuring payment and tax settings, and meeting accessibility, marketing, and record-keeping duties. You must provide your own website terms and privacy notices where required. Flax's policies do not replace yours.
4.3 Site visitor and customer information
When you use Flax features to collect information from visitors, customers, students, members, attendees, or staff, you decide what information to collect and why. You are responsible for having a lawful basis, giving required notices, setting retention periods, responding to requests, and instructing Flax only as permitted by law. Our Privacy Policy explains how Flax processes that information for you.
5. Hosting, Availability, and Maintenance
Flax uses Bunny.net for content delivery, DNS, storage, and some database and edge services. Supabase provides account authentication and managed database services. Other Flax features may depend on payment, email, analytics, domain, AI, or integration providers. Website files and assets may be cached and delivered from Bunny's global CDN; some customer-facing features also use per-site databases.
Bunny.net's published Terms of Service state that Bunny aims for at least 99.995% monthly uptime for its content-delivery service, while also recognizing that the service may be unavailable and making no assurance of uninterrupted service. This is Bunny's stated aim for its content-delivery service; it is not a Flax uptime commitment, guarantee, or service-credit promise. It does not describe the availability of Flax's complete Service, APIs, databases, custom domains, or any particular website.
We do not promise uninterrupted or error-free access. Maintenance, security work, provider incidents, DNS or network issues, and events outside our control may affect the Service. You can check provider status at Bunny's status page and Supabase's status page. Any uptime remedy or service credit applies only if we expressly offer it in a separate written agreement.
6. Domains and Third-Party Services
You may connect a domain you own or purchase a domain through an available provider. Domain registration, renewal, transfer, and cancellation are subject to the registrar's and registry's rules. You are responsible for accurate registrant information, required consent, DNS instructions, renewal fees, and maintaining your right to use the domain. A domain may be suspended, transferred, or lost under applicable registry or registrar rules.
Optional integrations such as Google services, analytics, social networks, payment tools, email, and AI providers are operated by third parties. You choose whether to connect them and are responsible for reviewing their terms, permissions, and privacy practices. An integration can stop working if a provider changes or withdraws its service, API, or authorization. You may disconnect integrations in Flax where supported or revoke access with the provider.
7. AI and Agent Features
Flax and connected agents may draft, edit, translate, analyze, or recommend content using information and instructions you provide. Automated output can be incomplete, inaccurate, outdated, or unsuitable for your business. Review it, verify factual and legal claims, and confirm that you have rights to publish it before making it public. Unless a feature states otherwise, an agent proposal does not publish changes until the required owner review is complete.
AI features may send the relevant prompt, files, site context, and connected data to the AI provider configured for that feature so it can return a result. The data handling for those features is described in our Privacy Policy. You are responsible for the instructions you give an agent and for checking its work. Flax does not guarantee search rankings, traffic, leads, sales, or other business results.
8. Acceptable Use
You must use the Service lawfully and follow our Acceptable Use Policy. You must not use Flax to host illegal or harmful content, infringe another person's rights, impersonate someone, distribute malware, send spam, mislead visitors, evade security controls, or interfere with the Service or another customer's use. You must not use the Service for a prohibited business or activity listed in the Acceptable Use Policy.
9. Suspension and Termination
You can stop using the Service and close your account by contacting contact@flaxsites.com. Subscription cancellation is handled under Section 3. If an account or site is closed, we handle its information under the retention and deletion terms in our Privacy Policy.
We may restrict or suspend access if reasonably necessary to protect users or the Service, address suspected fraud or security risks, enforce these Terms or the Acceptable Use Policy, respond to a legal requirement, or address non-payment. Where appropriate and lawful, we will give notice and an opportunity to resolve the issue. We may terminate access for serious or repeated violations or if we discontinue the Service. Nothing in this section prevents a remedy required by law.
10. Privacy
Our Privacy Policy describes the personal information Flax processes and your privacy choices. If you use Flax to process information on behalf of your customers or visitors, you must provide the notices and instructions required by law. Contact us at contact@flaxsites.com if you need information about data-processing arrangements for your account.
11. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available." We do not warrant that the Service will be uninterrupted, secure, error-free, compatible with every device or third-party service, or suitable for a particular purpose. You are responsible for keeping copies of important content and for reviewing site changes before publishing them.
Nothing in these Terms excludes or limits a warranty or consumer right that cannot legally be excluded or limited where you live.
12. Limitation of Liability
To the maximum extent permitted by law, Flax and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses, or for loss of profit, revenue, goodwill, opportunity, or data. To the maximum extent permitted by law, Flax's total liability for claims arising from the Service will not exceed the fees you paid Flax for the Service during the 12 months before the event giving rise to the claim.
These limits do not apply to liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by negligence where the law does not permit that limitation. Nothing in these Terms removes rights you have as a consumer under mandatory local law.
13. Indemnity
To the extent permitted by law, you will defend and indemnify Flax against third-party claims, losses, and reasonable costs arising from Your Content, a website or transaction you operate, your misuse of the Service, or your material breach of these Terms, except to the extent a claim was caused by Flax's own breach or unlawful conduct. We will give you reasonable notice of a covered claim and cooperate at your expense. You may not settle a claim in a way that admits liability for Flax or imposes obligations on Flax without our written consent.
14. Governing Law and Disputes
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules. The courts of England and Wales have jurisdiction over disputes, subject to any mandatory rights you have to bring a claim in the courts of your country of residence. We encourage you to contact us first so we can try to resolve a concern informally.
15. Changes and General Terms
- We may update these Terms by posting a new version here and changing the date above. For material changes, we will provide notice by email or through the Service where appropriate. Changes apply from their stated effective date and do not retroactively alter a dispute that arose earlier.
- These Terms, the Privacy Policy, the Acceptable Use Policy, and any plan-specific terms shown at checkout form the agreement about your use of the Service. If a separate signed agreement conflicts with these Terms, the signed agreement controls for that conflict.
- If a court finds a term unenforceable, the remaining terms continue to apply to the extent permitted by law. A delay in enforcing a term is not a waiver. You may not transfer your account or these Terms without our consent; we may transfer them as part of a business reorganization or transfer of the Service, subject to applicable law.
- You and Flax are independent parties. These Terms do not create an agency, partnership, employment, or joint-venture relationship.
